10 Reasons Why You Should Attend This Year’s AGM - Reason 2
This year's AGM will be held at 6:30PM on Tuesday, September 27, 2016 at the Saint-Laurent Centre des Loisirs.
Article 11.2.11 or our DCO concerning the role of Administrators:
Adopt regulations concerning the operation and use of the property regarding any matter which, in their opinion, must be the subject of a regulation or amendment of a regulation already in effect, such regulations will remain in effect unless they are revoked or amended by a majority vote of co-proprietors.
We have come to realize that Clause 11.2.11 of our Declaration of Co-Ownership implies a somewhat different procedure than what we have historically done to adopt regulations at the AGM.
According to the Quebec Civil Code and this clause, our historical practice of asking for submissions of new regulations to be added to the AGM agenda is somewhat inconsistent to what we should be doing.
In fact, it is ONLY the board that can pass new regulations and then submit them to the AGM to give the co-owners the opportunity to revoke what we passed. Actually, we could continue our current practice of having co-owners propose changes to our regulations at the AGM. However, if passed by the AGM, the board would still have to vote to adopt the new regulation before it actually becomes official. There is a risk that a new regulation passed by the AGM could be rejected by the board. It obviously would be better to follow the exact procedure prescribed by our DCO and the Civil Code.
Therefore, we recommend that if you wish to propose a new regulation, you first submit them to the board in order for it to be adopted at the next monthly meeting. Our monthly meetings normally occur on the second Tuesday of each month.
If we see an issue with what you propose, we will work with you to adjust what you have submitted to something we can pass.
